Widow of FDNY fireman killed in film set blaze wants to sue city

The widow of a Harlem firefighter who perished in a blaze on an Ed Norton film set is asking a judge to allow her to sue the city even though she’s past the deadline.

A lawyer for Eileen Davidson — whose husband, Michael Davidson, died while fighting the March 22, 2018, blaze — filed the petition in Manhattan Supreme Court on Friday.

She is seeking to file a late notice of claim, the legal precursor to suing, arguing that new evidence from other civil cases has uncovered culpability by the city.

Several lawsuits have already been filed against the landlord of the 773 St. Nicholas Ave. building and the production company, Class 5 Inc., by Davidson and tenants.

The location was being used in the upcoming flick, “Motherless Brooklyn,” which also stars Bruce Willis.

The production company claims in court papers that it got filming permits from the New York Fire Department and the city Department of Buildings.

The FDNY had inspected the location three times before the fire, but a March inspection report revealed that the sprinklers didn’t go off during the blaze. And the DOB had open violations against the landlord, one of which was for the boiler, which the inspection report says sparked the fire.

Therefore the city is responsible for not providing Davidson with a safe workplace, according to the court papers.

A rep with the City Law Department said, “We will review the filing.”
